Job Summary

We are currently seeking skilled and team-oriented applicants for the following position – Assistant Vice President of Business Services. The Assistant Vice President of Business Services handles the negotiation of complex contracts on behalf of the university, including real estate, intellectual property, data security and privacy, and many others. The AVP serves as the real estate officer for the university. The AVP also serves as the data privacy and HIPAA privacy officer. In addition, the AVP supervises the work of public records, records retention, procurement and contracts, and environmental health and safety. The AVP is responsible for enterprise risk management strategies, which involves leading a proactive and collaborative approach to risk assessment, management and mitigation. The AVP supervises the Director of Risk Management, who handles traditional risk management duties and insurance. This position requires a high-level knowledge of the legal obligations of an institution of higher education, the ability to prioritize a heavy workload, solid supervisory skills, and the ability to work collegially in a decentralized environment of shared governance.

The salary for this position is $117,972 (minimum) up to $136,000 (maximum) being offered. Where the hired candidate will begin within this range is dependent on education, experience, and skills. In addition to salary, the university offers a comprehensive benefits package including health insurance and disability insurance and retirement. Conditions of Employment

This position, during the course of university employment will be involved in the receipt of, or accountability for, university funds or other items of value, as well as the unsupervised access with the developmentally disabled, vulnerable adults or children under the age of 16. The offer of employment is contingent upon successful completion and passing of a background check prior to beginning employment.

Required Qualifications

  • Juris doctorate;
  • 5 or more years of experience in contract law, negotiation, and administration;
  • Experiencing with advising on compliance obligations with respect to state and federal laws; and,
  • Experience with discovery, public records requests, and/or insurance.

Preferred Qualifications

  • Previous experience working at an institution of higher education
  • Previous supervisory experience
  • Previous experience with data privacy

Responsibility / Duty

Procurement & Contracts
  • Responsible for the strategic leadership, oversight, and management of all contract-related activities at EWU. This includes the development, negotiation, review, and execution of a wide variety of contracts, agreements, and memorandums of understanding. The position ensures contracts align with the university’s mission, policies, and legal requirements while mitigating risk and supporting institutional goals.
  • Requires a high level of expertise in contract law, negotiation and administration, as well as the ability to collaborate effectively with internal and external stakeholders. This requires a high-level knowledge of public works, information security, data privacy, insurance, and contractual requirements.
  • Supervises the department of Procurement & Contracts. This department is responsible for handling all contracts for the purchase of goods and services, along with other types of contractual agreements such as affiliation agreements for practicum placements. This unit also facilitates the purchasing process in Banner by creating vendors, encumbrances, requisitions, and purchase orders. It also administers and audits the use of purchasing cards, fuel cards, and corporate accounts with various vendors.

Data Privacy Officer
  • Serve as the university point of contact for students, employees, and outside persons regarding concerns about data privacy.
  • Review and monitor EWU’s website privacy notices, data collection practices, and access/disclosure practices to ensure compliance with all relevant state, federal, and international laws.
  • Maintain current knowledge of legislative and regulatory changes affecting the collection, retention, and use of personally identifiable data; maintain understanding of technological advances that may have privacy implications.
  • Establish university guidelines and best practices to ensure long range university implementation of privacy and confidentiality practices; recommend, develop, implement, and oversee corrective action and mitigation efforts to correct deficient practices and improve compliance.
  • Serve as EWU’s HIPAA privacy officer.
  • In conjunction with the CIO, serve as a member of the data breach incident response team; lead the risk of harm assessment procedure with respect to incidents involving personally identifiable information, and direct the sending of breach notifications as required by state and federal law; ensure adequate documentation of security incidents, responses, and notifications is maintained.
  • Provide training to the campus community about data privacy and confidentiality requirements including, but not limited to, FERPA, HIPAA, GLBA, and GDPR.
  • Investigate privacy and confidentiality complaints concerning EWU; in coordination with the Human Resources, conduct personnel investigations as necessary.
  • Perform periodic risk assessments related to privacy and confidentiality.

Risk Management
  • Directs and leads EWU’s enterprise risk management strategies. This includes identifying, transferring, mitigating, and responding to risks. The unit is intended to provide support and guidance on a wide-variety of risks facing EWU, especially with respect to compliance, legal, and reputational risks.
  • Supervises the Director of Risk Management who is responsible for handling all insurance matters on behalf of EWU, including the procurement of insurance, insurance audits, and managing claims with EWU’s insurers. This includes insurance such as property, cyber liability, international travel, student professional liability, summer camp, student athlete, drone, marine, and automobile insurance. The director is also responsible for conducting risk assessments for activities occurring on campus, administering EWU’s youth protection program, and serving as the export control officer.
  • Support gathering of documentation in response to discovery requests.

Public Records, Subpoenas, Records Management
  • Responsible for oversight of the Public Records Manager. The Public Records Manager, in conjunction with risk management, is responsible for responding to all public records requests, subpoenas, search warrants, and FERPA requests on behalf of EWU.
  • This unit is also responsible for maintaining the records retention schedule, providing training to campus, and monitoring compliance with public records and records retention requirements.

Real Estate & Intellectual Property Agreements
  • Serves as the real estate officer for EWU. Negotiates and signs real estate agreements when EWU is acting as the lessee or the lessor.
  • Serves on the intellectual property committee. Drafts agreements and work with outside legal counsel on assignment of rights, patent applications, and technology transfer agreements.
  • Reviews contracts involving grants and research in conjunction with the Office of Grants and Research Development.
